Chapter 5 Supervision and Administration
Article 45 the aqsiq shall implement a safety monitoring system for imported and exported meat products, formulate key monitoring plans based on risk analysis and the actual situation of inspection and quarantine, and determine the types of imported and exported meat products and inspection items under key monitoring in the country or region.
The inspection and quarantine institution shall, in accordance with the annual risk monitoring plan of aqsiq for import and export food safety, formulate and implement the risk management plan for imported meat products within its jurisdiction.
Article 46 the aqsiq and the inspection and quarantine institutions shall exercise risk management over the import and export of meat. Specific measures shall be implemented in accordance with relevant regulations.
Article 47 the aqsiq and the inspection and quarantine institutions shall timely inform relevant departments, institutions and enterprises of the safety risk information of import and export meat products. Upon discovery of safety accidents of import and export meat products or receipt of reports on safety accidents of import and export meat products, they shall immediately notify the administrative departments of public health and agriculture and report to the relevant regulations.
Article 48 the production enterprises, consignees and consignors of import and export meat products shall produce and operate them lawfully.
The inspection and quarantine institution shall establish a system of bad records for the consignees, consignors and producers of import and export meat products.
Article 49 if there are safety problems in imported meat products that may or have caused damage to human health and life safety, the consignee shall take the initiative to recall the products and immediately report to the local inspection and quarantine institution. If the consignee fails to recall voluntarily, the inspection and quarantine organ shall order the recall according to relevant provisions.
If there are safety problems in the export meat products, which may or have caused damage to human health and life safety, the production enterprise of the export meat products shall take measures to avoid and reduce the damage and report to the local inspection and quarantine institution immediately.
The inspection and quarantine organ shall timely report to the aqsiq any situation specified in the preceding two paragraphs.
Article 50 the record keeping of a record-keeping farm for animals used for processing export meat products shall be cancelled if any of the following ACTS occur:
(1) storing or using drugs and other toxic and harmful substances that are prohibited from use in China or intended to be exported to other countries or regions, failing to indicate the active ingredients of the drugs used or to use drugs that contain banned drugs and drug additives, failing to stop taking the drugs during the suspension period as prescribed;
(2) providing false certificates of supply, transferring or transferring the record number in disguised form;
(3) concealing a serious animal epidemic or failing to timely report to the inspection and quarantine organ;
(4) refusing to accept the supervision and administration of the inspection and quarantine organ;
(5) failing to apply for change within 30 days after the name and legal representative of the feedlot for the record are changed;
(6) failing to report to the inspection and quarantine organ within 30 days after the expansion of breeding scale, the use of new drugs or feed or the major changes in the quality and safety system;
(7) no export supply within one year.
Article 51 any producer of import or export meat products that commits other illegal ACTS shall be punished in accordance with relevant laws and administrative regulations.
Article 52 any inspection and quarantine institution or its staff who violates the provisions of laws, regulations or these measures in the process of inspection and quarantine, supervision and administration of import and export meat products shall be investigated and dealt with in accordance with the provisions.
Supplementary Provisions
Article 53 these measures shall be interpreted by aqsiq.
Article 54 these measures shall come into force as of June 1, 2011. The administrative measures on inspection and quarantine of import and export meat products (order no. 26 of the aqsiq) promulgated by the aqsiq on August 22, 2002 shall be abolished simultaneously.
