Chapter 2 Import Inspection And Quarantine

Article 7 imported meat products shall conform to the requirements of Chinese laws, administrative regulations and national food safety standards, as well as the inspection and quarantine requirements specified in the relevant agreements, protocols and memoranda signed between China and the exporting countries or regions and the quarantine requirements specified in the trade contracts.

For the import of meat products without the national food safety standards, the consignee shall submit to the inspection and quarantine institution the license certificate issued by the health administration department under the State Council.

Article 8 the state quality supervision, inspection and quarantine according to Chinese laws, administrative rules and regulations, the national food safety standards, epidemic disease of meat products at home and abroad, and risk analysis of toxic and harmful substances as a result, the combination of quasi export meat products to China the effectiveness of the quality and safety management system of the country or region to assess the situation, formulate and publish China imported meat products inspection and quarantine requirements;Or sign an inspection and quarantine agreement with the country or region that intends to export meat products to China to determine the inspection and quarantine requirements and relevant certificates.

Article 9 the aqsiq shall put on record the exporters or agents of meat products exported to China and regularly publish the list of exporters or agents that have been put on record.

The registration and administration of the overseas producers of imported meat products shall be carried out in accordance with the relevant provisions of the general administration of quality supervision, inspection and quarantine of the People’s Republic of China.

Article 10 inspection and quarantine institutions shall put on record the consignee of imported meat products. The consignee who has implemented the administration of archival filing may go through the formalities for the import of meat products.

Article 11 the consignee for imported meat products shall establish a record system for the import and sale of meat products. The records shall be authentic and shall be kept for not less than two years.

Article 12 the aqsiq shall adopt a quarantine examination and approval system for imported meat products. The consignee of imported meat products shall go through the formalities of quarantine examination and approval before signing the trade contract and obtain the entry animal and plant quarantine license.

The aqsiq may, when necessary and in accordance with relevant regulations, send personnel to the exporting countries or regions for pre-inspection of imported meat products.

Article 13 imported meat products shall be imported from the ports designated by the aqsiq.

The inspection and quarantine organ at the import port shall have the equipment and facilities for on-site inspection and laboratory inspection and quarantine of imported meat products and the corresponding professional and technical personnel.

Imported meat products shall be stored in refrigerated warehouses or other places recognized by the inspection and quarantine institutions and reported to the aqsiq for the record. The port of import of meat products shall have refrigerated warehouses corresponding to the quantity of imported meat products. Refrigerated warehouses shall meet the requirements for inspection and quarantine of refrigerated warehouses for imported meat products.

Article 14 packaging of imported frozen meat products shall meet the following requirements:

(1) the inner and outer packaging shall be made of non-toxic and harmless materials, intact and without damage;

(2) the country of origin, the name of the product, the registration number of the production enterprise and the production batch number shall be indicated on the inner and outer packaging;

(3) on the outer package, specifications, origin (specific to the state/province/city), destination, production date, shelf life, storage temperature and other contents shall be indicated in Chinese.

Article 15 before the import of meat products or at the time of import, the consignee or his agent shall apply to the inspection and quarantine organ of the import port on the strength of the original copy of the import animal and plant quarantine license, the relevant certificate issued by the authorities of the exporting country or region, the trade contract, the bill of lading, the packing list, the invoice and other documents.

The official inspection and quarantine certificate of the exporting country or region attached to the imported meat product shall conform to the requirements of the aqsiq on the certificate.

Article 16 the inspection and quarantine organ shall examine and verify the relevant documents submitted by the consignee or his agent, accept the application for inspection if the documents meet the requirements, cancel the quantity examined and approved by the quarantine, and issue a customs clearance certificate for the entry goods.

Article 17 means of transport and containers carrying imported meat products shall be sterilized for epidemic prevention under the supervision of the inspection and quarantine organ of the import port. Without the permission of the inspection and quarantine organ, the imported meat products shall not be unloaded from the means of transport and containers.

Article 18 the inspection and quarantine organ of an import port shall, in accordance with regulations, carry out on-site inspection and quarantine on imported meat products, which shall include the following contents:

(1) check whether the transportation vehicle is clean and hygienic, has no peculiar smell, whether the temperature control equipment and facilities operate normally, and whether the temperature record meets the requirements;

(2) check the conformity of the certificate of goods, including container number and seal number, name of goods, quantity (weight) and quantity of goods, name or registration number of the exporting country or region, name of the manufacturing enterprise, date of production, package, shipping mark, official certificate number, mark or seal of the exporting country or region, etc.;

(3) check whether the packaging conforms to the national food safety standards;

(iv) whether the labels of pre-packaged meat products meet the requirements;

(v) fresh frozen meat products should also be checked for freshness, whether the central temperature meets the requirements, whether there are lesions, visible parasitic tomont, living pests, foreign matter and other abnormal conditions, and cooking test should be carried out when necessary.

Article 19 after the imported fresh frozen meat products pass the on-site inspection and quarantine, they shall be transported to a place designated by the inspection and quarantine institution for storage.

Article 20 the inspection and quarantine institutions shall, in accordance with relevant provisions, take samples of imported meat products and carry out inspection or monitoring in accordance with relevant standards, monitoring plans, warning circulations and other requirements.

Article 21 according to the inspection and quarantine results of imported meat products, the inspection and quarantine organ of the port shall make the following treatment:

(1) if the goods pass the inspection and quarantine, a certificate of inspection and quarantine for entry goods shall be issued and approved for production, processing, sales and use. The inspection and quarantine certificate of entry goods shall indicate the container number, production batch number, manufacturer name, registration number, shipping mark and other traceability information of the imported meat products.

(2) if the products fail to pass the inspection and quarantine, a notice of inspection and quarantine treatment shall be issued. In any of the following cases, it shall be returned or destroyed:

  1. Without a valid import animal and plant quarantine license;
  2. There is no relevant certificate issued by the official organ of the exporting country or region;
  3. Imported meat products produced by unregistered production enterprises;
  4. The project involving personal safety, health and environmental protection is unqualified.

(3) where, after inspection and quarantine, any item other than personal safety, health or environmental protection fails to meet the standards, technical treatment may be carried out under the supervision of the inspection and quarantine organ.

(4) relevant certificates shall be issued if claims for compensation are needed.

Article 22 where the meat products imported from the mainland are unloaded from the original transport vessels in Hong Kong or Macao and transported to the mainland by land via Hong Kong or Macao, or are loaded into other port areas for transportation to the mainland after unloading at the docks in Hong Kong or Macao, the consignor shall apply to the inspection institution designated by the aqsiq for transshipment pre-inspection. No transshipment to the mainland shall be made without or without the pre-inspection.

The designated inspection institution shall, in accordance with the requirements of the saqsiq, carry out pre-inspection, apply a new seal and issue a certificate upon passing the inspection, and the inspection and quarantine organ of the entry port shall examine the certificate at the same time when accepting the inspection application.
